Agreement to Terms

Cull is operated by Homespect Ltd, a company registered in England and Wales ("we", "us", "our"), trading as Cull.

By downloading, installing, or using Cull ("the app"), you agree to be bound by these Terms of Use. If you do not agree, do not use the app.

Description of Service

Cull is a food product scanning application that provides nutritional information and health scores for food products. The app uses barcode scanning, product databases, community-submitted data, and AI-powered analysis to retrieve and display this information.

Cull is not a medical device and is not regulated as such. It is intended for general informational and educational purposes only.

Health and Allergen Disclaimer

IMPORTANT: Cull is designed to provide general nutritional information and is NOT a substitute for professional medical, dietary, or nutritional advice.

Health scores are algorithmic estimates based on publicly available nutritional data
AI-powered ingredient analysis may contain inaccuracies or incomplete information
Scores and analysis are for guidance only and should not replace professional advice
Scores may not account for individual health conditions, allergies, or intolerances
Always consult a healthcare professional for medical or dietary advice
Always read actual product packaging for allergen and ingredient information
We do not guarantee the accuracy of third-party nutritional data, community-submitted data, or AI-generated content

Cull shall not be liable for any injury, illness, allergic reaction, or adverse health outcome arising from reliance on information provided by the app. You assume full responsibility for verifying allergen and nutritional information against actual product packaging before consumption.

Data Sources and Accuracy

Product information is sourced from:

Open Food Facts — a collaborative, open-source database of food products
Community submissions — product data and photos submitted by Cull users through Smart Scan

While we strive for accuracy:

Data may be incomplete, outdated, or incorrect
Product formulations may change without database updates
Regional variations in ingredients and labelling may exist
Community-submitted data is verified by AI but may still contain errors

Always verify critical information — especially allergens and ingredients — by reading the actual product packaging.

Eligibility and Age Requirements

You must be at least 13 years old to use Cull. If you are under 18, you must have permission from a parent or guardian. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us and we will delete it.

Subscription Terms

Cull Pro Subscription:

Monthly: £2.49/month · Annual: £16.99/year (save 43%)
Payment is charged to your Apple ID account at confirmation of purchase
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel subscriptions in your Apple ID Account Settings
Refunds are handled by Apple in accordance with their refund policy
If you cancel, your Pro features remain active until the end of the current billing period

Free Tier:

Unlimited barcode scanning, health scores, nutrition analysis, scan history, and favourites. AI Chat, dietary profiles, and product comparison require Cull Pro.

Community Contributions

When you submit product data (photos, nutritional information) to our community database, you grant Cull a non-exclusive, worldwide, royalty-free licence to use, display, and distribute the submitted information to improve the product database for all users. You confirm that submitted photos depict actual food products and are your own work.

All submissions are subject to AI verification and moderation. You may request deletion of your submissions by contacting us; however, product data that has been incorporated into the community database may be retained in anonymised form.

Your Account and Data

You may use Cull without creating an account. If you sign in with Apple, your scan history, favourites, and dietary preferences are synced across your devices. You may delete your account at any time from Settings, which removes all personal data associated with your account. For full details on data we collect and how it is used, see our Privacy Policy.

Acceptable Use

You agree not to:

Use the app for any unlawful purpose
Attempt to reverse engineer, decompile, or extract source code
Interfere with or disrupt the app's functionality or servers
Use automated systems to access the app excessively
Submit false, misleading, or inappropriate product information
Misrepresent health information from the app to others
Attempt to access other users' data or accounts

Intellectual Property

The Cull app, including its design, features, algorithms, and content, is owned by Homespect Ltd and protected by copyright and other intellectual property laws. You may not copy, reproduce, create derivative works, distribute, or publicly display app content without prior written permission.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and accuracy
We are not liable for any health decisions, dietary choices, or allergic reactions resulting from reliance on app information
We are not liable for any indirect, incidental, special, or consequential damages, including loss of data, loss of profits, or personal injury
Our total liability shall not exceed the amount you paid for the app in the preceding 12 months

Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

Indemnification

You agree to indemnify and hold harmless Homespect Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the app, your violation of these terms, or your infringement of any third-party rights.

Termination

We reserve the right to terminate or suspend your access to the app at any time, without prior notice, for conduct that we believe violates these terms or is harmful to other users. If your access is terminated while you have an active Cull Pro subscription, your subscription will not be automatically cancelled — you must cancel it through your Apple ID Account Settings.

Changes to Terms

We may modify these terms at any time. Material changes will be communicated through the app or via email where possible. Continued use of the app after changes constitutes acceptance of the updated terms. If you do not agree with any changes, you should stop using the app.

Severability

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer in the European Union, you retain any mandatory consumer protection rights afforded to you under the laws of your country of residence.
